  1. OUR COMMERCIAL POLICY

1.1

The Seller offers for sale, on laboniagloves.com, the products and carries out its e-commerce activities exclusively towards its end users who are "consumers".

1.2

When we speak of "consumer" we refer to any natural person acting on laboniagloves.com with purposes not related to their commercial, entrepreneurial or professional activity, possibly carried out. If you are not a "consumer", please refrain from concluding commercial transactions on laboniagloves.com

1.3

In consideration of its commercial policy, the Seller reserves the right not to follow up orders from subjects other than the "consumer" or in any case to orders that do not comply with its commercial policy.

1.4

These General Terms and Conditions of Sale exclusively govern the offer, submission and acceptance of purchase orders for products on laboniagloves.com between users of laboniagloves.com and the Seller.

1.5

The General Conditions of Sale do not, however, regulate the provision of services or the sale of products by any person other than the Seller who is present on laboniagloves.com through links, banners or other hyperlinks. We advise you, before placing orders and buying products and services from subjects other than the Seller, to check their conditions of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller or for the conclusion of e-commerce transactions between users of laboniagloves.com and third parties.

  1. HOW TO CONCLUDE THE CONTRACT WITH THE SELLER

2.1

To conclude the purchase contract for one or more products on laboniagloves.com, you must complete the order form in electronic format and send it to the Seller, electronically, following the relevant instructions.

2.2

Before purchasing the products, by sending the order form, you will be asked to carefully read the General Conditions of Sale and the Information on the right of withdrawal. We will also provide you with a summary of the information on the essential characteristics of each product ordered with its price (including all applicable taxes or charges), the means of payment that you can use to purchase each product, the methods of delivery of the purchased products, the methods of handling complaints by the professional, shipping and delivery costs; as well as the references and geographical and e-mail address of the Seller and the date by which the Seller undertakes to deliver the goods. The Seller will also provide you with a summary of the terms and conditions for the exercise of your right of withdrawal and the methods and times for returning the products purchased (taken from the Return and Exchange Form). You will also be informed of the circumstances in which you will lose the right to withdraw from the contract. If applicable to the purchase, you will be informed that, in case of withdrawal, you will have to bear the cost of returning the products. You will, in any case, be reminded of the existence of the legal guarantee of conformity of the products, you will be provided with the contact details of our after-sales service.

2.3

In the order form, displayed immediately before the conclusion of the purchase contract, we will provide you with summary information about the essential characteristics of each product ordered, the price (including all applicable taxes or charges) and shipping costs (including any additional costs incurred by you for choosing a type of shipment and delivery different and/ or faster than the standard). The contract is concluded when the Seller receives, electronically, your order form, after checking the correctness of the data relating to your order.

2.4

The order form will be stored in our database for the period of time necessary for the processing of orders and in any case within the terms of law. You can access your order form by consulting the My order section.

2.5

When sending the order form, you will be informed that such forwarding implies the obligation to pay the indicated price.

Before proceeding with the transmission of the order form, you will be required to identify and correct any errors in data entry.

2.6

The language available to conclude the contract with the Seller is Italian in the Italian version and English in the English version.

2.7

Once the contract has been concluded, the Seller will take charge of your purchase order.

2.8

The Seller may not process your purchase orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in case of unavailability of the products. In these cases, we will inform you by e-mail that the contract is not concluded and that the Seller has not followed up your purchase order specifying the reasons. If the products, presented on laboniagloves.com, are no longer available or for sale at the time of its last access to the site or sending the order form, it will be the responsibility of the Seller to communicate them, promptly and in any case within thirty (30) days from the day following that on which you have sent your order to the Seller, the possible unavailability of the products ordered. In case of forwarding of the order form and payment of the price, the Seller will refund, without undue delay, what you have already anticipated and the contract will be considered terminated between the parties.

2.9

By sending the order form electronically, you unconditionally accept and undertake to comply, in relations with the Seller, these General Conditions of Sale. If you do not agree with some of the terms of the General Conditions of Sale, please do not submit the order form for the purchase of products on laboniagloves.com.

2.10

By sending the order form you confirm that you know and accept the General Terms and Conditions of Sale and the additional information contained in laboniagloves.com, also referred to via link, including the General Conditions of Use and the Privacy Policy and the Right of Withdrawal.

2.11

Once the contract is concluded, the Seller will send you, by e-mail, a receipt of the purchase order, containing the General Conditions of Sale and the summary document on the Right of Withdrawal and therefore, all the information already contained in the summary of the commercial and contractual conditions displayed before purchasing.

2.12

All direct shipments outside the European Union are subject to the payment of customs duties that cannot be calculated when we receive the order. At the time of delivery the customer will be required to pay such customs duties in addition to the cost of transport and the purchased goods

  1. GUARANTEES AND INDICATION OF PRODUCT PRICES

3.1

On laboniagloves.com are offered for sale exclusively products marked by the brand Labonià Gloves made by the Seller at the fashion house and/ or the manufacturer authorized by the fashion house.

3.2

The Seller does not sell used, irregular or inferior quality products to the corresponding standards offered on the market.

3.3

The essential characteristics of the products are presented on laboniagloves.com within each product sheet. However, the images and colours of the products offered for sale on laboniagloves.com may not be the same as the actual ones due to the Internet browser and the monitor used.

3.4

Product prices may be subject to updates. Check the final sale price before submitting the relevant order form.

3.5

Purchase requests from countries not included among those available cannot be accepted by the Seller.

3.6

All products are equipped with an identification tag fixed with a thread seal sewn by hand by our artisans. We ask you not to remove the tag and its seal from the purchased products, of which they are an integral part in case you wish to exercise the right of withdrawal.

4. WITHDRAWAL

The Seller, in case of exercise of your right of withdrawal, has the right not to accept the refund or not to refund in full the sums paid for the purchase, in relation to those products which are not labelled or which have been altered in their essential and qualitative characteristics or which have been damaged.

  1. PAYMENTS

5.1

To pay the price of the products and the related shipping and delivery costs, you can follow one of the methods indicated in the order form. In no case will you be charged for costs higher than those actually incurred by the Seller, in relation to the payment instrument you have chosen.

5.2

In case of payment by PayPal, the Customer will be redirected to the PayPal website where he can make the payment with his account in the manner accepted by Paypal and in compliance with the relevant conditions. Moreover, this information will never be used by the Seller other than to complete the procedures relating to your purchase and to issue refunds in the event of any product returns, following the exercise of your right of withdrawal, or if it is necessary to prevent or report the fraud commission on laboniagloves.com. The price for the purchase of the products and the shipping costs, as indicated in the order form, will be charged to your account at the time of shipment of the products purchased. For purchases made by bank transfer, we remind you that within five working days you will have to make the transfer to Labonìa Gloves Srl indicating the order number for the purchase reported in the purchase confirmation email.

  1. SHIPMENT AND DELIVERY OF PRODUCTS

The specific methods of shipping and delivery of the products will take place by express courier once the transaction or transfer will be notified by the credit card operator or the seller’s bank.

  1. RIGHT OF WITHDRAWAL

8.1

You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) days from the day of receipt of the products purchased on laboniagloves.com. We remind you that this section 8 is not applicable to Customized Products as indicated in the previous section 3 of these General Conditions of Sale.

8.2

To withdraw from the contract, you can send an email to info@laboniagloves.com, sending the Seller an explicit statement of your decision to withdraw from the contract.

If you choose, instead, to send a declaration of withdrawal, the burden of proving the correct and timely exercise of the right of withdrawal will be on you.

8.3

Once the withdrawal from the contract has been exercised, you must return the products to the Seller and deliver them to the courier for shipment within fourteen (14) days from the moment you notify the Seller of your decision to withdraw from the contract.

8.4

The only costs to be borne by you are those of returning the purchased products.

8.5

To return the purchased goods, you must pay the cost of returning the purchased products yourself. In this case, you may remain liable in case of loss or damage to the products during transport, which is due to your negligent choice of carrier and/or shipping methods.

8.6

The Right of Withdrawal - in addition to compliance with the terms and conditions described in paragraphs 8.1, 8.2, 8.3 and 8.4 above - is considered to be correctly exercised if the following conditions are fully complied with:

8.7

If the Right of Withdrawal is exercised in accordance with the methods and terms indicated in this paragraph 8, the Seller shall refund any sums already collected for the purchase of the products according to the methods and terms provided.

8.8

The sums will be refunded to you as soon as possible and, in any case, within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal, we will activate the refund procedures, after verifying that the above terms and conditions have been correctly implemented, as indicated in paragraph 9.

8.9

If the terms and conditions for the exercise of your right of withdrawal are not respected, you will not be entitled to a refund of the sums already paid to the Seller. Within 14 days from the sending of the e-mail with which you will be notified of the non-acceptance of the return, you can choose to regain, at your own expense, the products in the state in which they were returned to the Seller, giving notice to the Seller, in the manner that will be communicated to you. Otherwise, the Seller may withhold the products, in addition to the sums already paid for their purchase.

If the conditions of paragraph 8.6 above are not met, you will not be entitled to a full refund of the amounts already paid to the Seller. It will, in fact, be responsible for the decrease in value of the returned products, resulting from a use different from that authorized by the Seller in order to allow it to ascertain the nature, characteristics and operation of the products themselves. In this case, a percentage between 10 and 90 percent of the amounts you paid to the Seller for the purchase of the returned products will be deducted from the refund, as specifically communicated to you by e-mail by the Seller. Within 14 days of sending the e-mail with which the sum deducted from the refund will be communicated to you, you may choose to regain, at your expense, the products in the state in which they were returned to the Seller, giving notice to the Seller, in the manner that will be communicated to you. Otherwise, the Seller may retain the products and an amount corresponding to the percentage deducted from the refund.

  1. REPAYMENT TIMES AND METHODS

9.1

After the return of the products, the Seller shall make the necessary checks regarding the conformity of the same with the conditions and terms indicated in paragraph 8. In the event that the checks are concluded positively, the Seller shall send them, by e-mail, the relevant confirmation of acceptance of the returned products. In the event that the checks are not concluded positively, the Seller shall inform you, by e-mail, of the existence of a decrease in value of the returned products, resulting from non-compliance, for your part, the conditions laid down in paragraph 8.6. At the same time, the Seller shall also inform you of the amount that will be deducted from the sums paid by you for the purchase of the returned products; alternatively, the possibility of regaining, at your expense, the products in the state in which they were returned to the Seller, as provided for in paragraph 8.9 above.

9.2

Whatever the method of payment you use, the refund, in full or in part, is activated by the Seller, in the shortest possible time and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal after checking the correct execution of your right of withdrawal and verification of the returned products.

9.3

The Seller makes the refund using the same means of payment used by you to purchase the returned products, unless you have expressly agreed with the Seller to use a different means of payment and provided that you do not incur any additional cost as a result of the refund.

If there is no correspondence between the recipient of the products indicated in the order form and who has paid the sums due for their purchase, the refund of the sums, in case of exercise of the right of withdrawal, will be made by the Seller, in any event, against whom the payment was made.

9.4

The currency date of the credit is the same as the debit; therefore you will not suffer any loss in terms of bank interest.

9.5

By using, for the return of the products, the shipper, will have to pay in person the necessary expenses and will remain at your responsibility in case of loss or damage to the products during transport, in accordance with the procedures and deadlines for the exercise of the right of withdrawal.

  1. APPLICABLE LAW AND DISPUTE RESOLUTION

11.1

The General Terms and Conditions of Sale are governed by Italian law and in particular by Legislative Decree no. 206 of 6 September 2005 on the Consumer Code in Chapter I of the Italian Civil Code. "Consumer Rights in Contracts"with specific reference to the legislation on distance contracts and Legislative Decree No. 70 of 9 April 2003 on certain aspects concerning electronic commerce.

11.2

In the event of disputes between the Seller and each end-user relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders, the Court of Milan shall have exclusive jurisdiction, any other place of jurisdiction excluded.

AMENDMENT AND UPDATING

The General Conditions of Sale are amended from time to time also in consideration of any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on laboniagloves.com.
